You can't. A background by its very nature is in the first layer, and the foreground is a layer over the top of it. Its kinda like two objects being on the Z axis - one MUST be in front of the other or they'll occupy the same space and neither will be background/foreground - they'll merge.

You *CAN* make two layers and then flatten them onto one... but then you'll lose the editability of two layers.
